Zofran birth defects lawsuits allege children are born with cleft palate, cleft lip, heart defects, musculoskeletal defects, and other abnormalities due to mothers being prescribed Zofran to treat morning sickness during early pregnancy. More than 380 Zofran lawsuits are pending in a multidistrict litigation in the District of Massachusetts for the complaints against Zofran’s maker, GlaxoSmithKline. The lawsuit, filed May 30 on behalf of the South Dakota mother, alleges that she was prescribed Zofran during her first trimester of pregnancy. According to the complaint, her child was born in 2005 with aberrant subclavian artery and vascular ring of aorta allegedly due to prenatal exposure to Zofran. The plaintiff alleges injuries of emotional distress and medical bills as a result of the congenital vascular abnormalities. Zofran (ondansetron) has been approved by the U.S. Food and Drug Administration (FDA) to treat nausea and vomiting associated with chemotherapy, radiation and surgery. Plaintiffs in Zofran lawsuits, however, accuse GlaxoSmithKline of promoting Zofran to treat morning sickness in pregnant women even though Zofran’s prescribing information says there have been “no adequate and well-controlled studies” conducted regarding pregnant women and Zofran use. The Zofran complaints point to scientific studies that support claims that Zofran has the potential to cause birth defects in newborns when the drug is prescribed during early pregnancy. For instance, a study conducted by the Center for Birth Defects Research and published in 2012 found that babies were twice as likely to be at risk for the cleft palate birth defect because of Zofran use during the first trimester of pregnancy. Research was presented in 2013 and based on 900,000 births from a Danish registry showed the increase in major congenital heart defects doubled in children whose mothers were prescribed ondansetron in the first trimester of pregnancy.

In 2012, GlaxoSmithKline reached a $3 billion settlement with the U.S. Department of Justice (DOJ) for improperly promoting Zofran and other drugs for uses not approved by the FDA and for failing to report certain safety data. The DOJ also accused the company of paying kickbacks to doctors who prescribed Zofran and other drugs for off-label uses.
