The complaint alleges a 67-year-old Louisiana woman suffered a fatal brain bleed after being prescribed the blood thinner. There are currently thousands of Xarelto lawsuits alleging the blood thinner causes gastrointestinal bleeding, hemorrhagic stroke, severe internal bleeding and other bleeding injuries and even death. The case selected for this bellwether trial was brought by the family of the Louisiana woman who first began taking Xarelto in February 2014 to treat atrial fibrillation. According to the complaint, the woman became ill in April 2015 and had to be hospitalized. She was found to have an acute brain hemorrhage and suffered a hemorrhagic stroke. Unfortunately, she succumbed to her injuries in May 2015. The lawsuit claims Xarelto’s manufacturer, Bayer HealthCare AG, and Johnson & Johnson’s Janssen Pharmaceuticals Inc., which markets Xarelto, failed to adequately warn about the blood thinner’s life-threatening bleeding side effects. The U.S. Food and Drug Administration (FDA) approved Xarelto (rivaroxaban) to prevent strokes, deep vein thrombosis, pulmonary embolism, and blood clots in patients with atrial fibrillation not caused by a heart valve problem. Xarelto is a new generation blood thinner promoted as being more convenient for patients to use compared to the blood thinner warfarin (Coumadin, Jantoven), which the FDA approved over 60 years ago. According to Bayer, patients taking Xarelto do not have to undergo routine blood monitoring as do patients who use warfarin. In addition, there are no known diet restrictions with Xarelto as there are for patients who use warfarin. Warfarin, however, uses vitamin K as an antidote to treat uncontrollable bleeding. Xarelto does not have an FDA-approved antidote to reverse its bleeding side effects.

U.S. District Judge Eldon E. Fallon, who is managing the multidistrict litigation for Xarelto lawsuits in Louisiana, has indicated the next bellwether trial will take place in the Southern District of Mississippi. This case involves a woman who suffered a gastrointestinal bleed allegedly after taking Xarelto. Another trial is scheduled in the Northern District of Texas for a case involving a man who died from gastrointestinal bleeding allegedly after he began using Xarelto.
