Xarelto Bleeding Lawsuits Allege Blood Thinner May Causes Severe Internal Bleeding With No Approved Antidote To Reverse The Anticoagulant Side-Effects.
As Xarelto bleeding lawsuits rise to nearly 15,000 in the Eastern Louisiana federal court, Bayer HealthCare and Janssen Pharmaceuticals have asked for summary judgment of failure to warn claims made in two cases selected for bellwether trials. The companies are defending themselves against allegations that they failed to adequately warn that the Xarelto blood thinner causes brain bleeds, gastrointestinal bleeds, blood clots and other bleeding side effects that require hospitalization or transfusions. Plaintiffs in both bellwether cases allege their doctors would not have prescribed Xarelto had Bayer and Janssen provided “stronger warnings” about the bleeding risks. Bayer and Janssen contend in their motions, filed on January 20, the plaintiffs’ doctors testified in depositions that they “understood from the label that Xarelto carries a risk of bleeding, including serious and fatal bleeding” and even knowing what they know today, they “still would have prescribed Xarelto” to the plaintiffs. Due to the doctors’ testimony, the defendants asked U.S. District Judge Eldon Fallon to dismiss the claims, as a matter of Louisiana law, under the learned-intermediary doctrine. Xarelto (rivaroxaban) is a blood thinner approved by the U.S. Food and Drug Administration (FDA) to prevent deep vein thrombosis and pulmonary embolism and to reduce the risk of stroke and blood clots in patients with atrial fibrillation not caused by a heart valve problem. Consumers find Xarelto more convenient to use because they do not have to undergo routine blood monitoring as do patients who are prescribed the blood thinner warfarin (Coumadin, Jantoven). However, should significant internal bleeding occur, Xarelto, first approved in 2011, does not have an antidote to reverse its effects whereas warfarin, approved over 50 years ago, uses vitamin K as a reversal agent, according to the FDA.
Court records show the first bellwether trial involves a Louisiana man who said he was prescribed Xarelto in January 2014 by his cardiologist to reduce the risk of stroke associated with his atrial fibrillation. Shortly after taking Xarelto, however, the plaintiff suffered a gastrointestinal bleed, according to his complaint.
