In an order issued on October 20, U.S. District Judge Joan N. Ericksen set the bellwether schedule for the two cases. According to the order, Judge Ericksen wants case specific discovery completed by December 8, 2017, initial and rebuttal expert reports and disclosures exchanged by December 15, 2017, depositions of expert witnesses completed by January 30, 2018, and case specific dispositive motions filed by February 6, 2018. 3M says that the Bair Hugger warming system is used by over 80 percent of U.S. hospitals to keep patients warm before, during, and after surgery. Bair Hugger’s warming system draws in filtered air from the operating room, passes it through an internal filter, and warms that air to a selected temperature, according to 3M’s promotional literature. The warmed air flows to a single-use Bair Hugger blanket through an enclosed hose, and then gently disperses across the surface of a patient’s skin.

3M says that its Bair Hugger warming device does not cause infection but benefits patients by maintaining normal body temperature during surgery, which reduces surgical bleeding, decreases post-operative heart attack, shortens recovery times, and reduces the risk of infection.

Conversely, Bair Hugger lawsuits contend the warming device’s design is defective because it draws contaminated particles or bacteria from the operating room floor, and from below the operating table and into the sterile surgical site. Some plaintiffs said they underwent multiple revision surgeries to remove their prosthetic device, and some suffered a knee amputation due to the joint infections.
