In a Case Management Order (CMO) issued August 29, U.S. District Judge Kurt D. Engelhardt suggested four more bellwether trial dates on:

• January 28, 2019
• April 8, 2019
• July 15, 2019
• November 4, 2019

Judge Engelhardt directed attorneys for plaintiffs and defendants to submit proposed CMOs for each of the four additional trials at a later date. Both sides have selected 10 potential cases for bellwether trials with the first trial scheduled to begin on September 24, 2018. Cases for bellwether trials serve as test cases to help plaintiffs, defendants and the court determine the outcome of future trials. Depending on the outcomes, the parties may consider settling similar lawsuits pending in litigation. Taxotere (docetaxel) is a medication used to treat locally advanced or metastatic breast cancer in women whose previous chemotherapy treatments failed. Taxotere was first approved by the U.S. Food and Drug Administration in 1996. The drug’s use was later expanded to treat prostate cancer, stomach cancer and head and neck cancer. Taxotere is part of a family of drugs known as Taxanes which interfere with cell growth and the spread of cancer cells in the body. Patients taking Taxotere reported side effects that include permanent hair loss (also known as alopecia), gastrointestinal bleeding, infections, nausea and vomiting, anemia, and skin reactions.

Plaintiffs in Taxotere lawsuits maintain Sanofi-Aventis failed to warn doctors and their patients that hair loss would be permanent after taking a Taxotere chemotherapy treatment. A lawsuit recently filed in the Taxotere multidistrict litigation in Louisiana alleges that a Tennessee woman who was prescribed Taxotere in 2010 lost her hair after taking the chemotherapy drug. According to the complaint, Taxotere’s warning label did not mention alopecia risks and only said that hair “generally grows back,” the lawsuit said.
