As the U.S. Judicial Panel on Multidistrict Litigation prepares to release updated numbers on IVC filter lawsuits filed, thousands of IVC filter complaints are already pending across the country. The inferior vena cava (IVC) filters have been the center of lawsuits since the U.S. Food and Drug Administration (FDA) warned in 2010 about problems associated with IVC filters such as tilting, migrating, fracturing, and perforating the heart, lungs and vena cava.
Cook Medical Inc., C.R. Bard and Cordis Corp. are among the medical manufacturers facing lawsuits over their IVC filters. The IVC filter lawsuits against the companies commonly allege that their medical devices used to reduce the risk of pulmonary embolism have design defects and cause health complications and place patients at risk for fatal blood clots.

IVC filters are small, cage-like devices implanted into the inferior vena cava. The filters are used to trap blood clots and stop them from reaching the lungs and causing a pulmonary embolism. IVC filters are implanted in patients who cannot take blood thinners or when anticoagulant therapy cannot be used or is ineffective. The FDA recommends removing retrievable IVC filters once the risk of blood cots subsides.
Court documents indicate that a multidistrict litigation (MDL) has been established for claims involving C.R. Bard’s Recovery and G2 IVC filters. Over 1,200 Bard IVC filter lawsuits are pending in the MDL in the U.S. District Court, District of Arizona. Southern Med Law is currently representing the family of an Alabama woman who died after suffering complications allegedly from her Cordis’ TrapEase IVC filter that had been implanted for five years. On September 19, 2014, the woman went to the emergency room after suffering from lower back pain, abdominal pain, nausea, and other complications. She was discharged the same day. However, the next day, she was taken by EMS to the emergency room after she was found unresponsive in her home.
