Southern Med Law is Currently Representing Women in Mirena IUD Lawsuit Claims Who Allegedly Sustained Uterine Perforations and Other Injuries Due to the Birth Control Device
Trials intended to test the strength of allegations put forth in nearly 1,800 Mirena IUD lawsuit claims will soon get underway in New Jersey Superior Court, where cases involving alleged spontaneous device migration have been consolidated for pretrial proceedings. According to an Order issued on March 17th, the Court has directed the parties to select 14 cases for the proceeding’s second bellwether trial. The selections must be submitted by July 2nd, so that the Court may begin the process of case-specific discovery. The second trial is expected to begin during the latter half of 2016, though no date has yet been selected. (In Re: Mirena Litigation; Case No. 297)

According to court documents, at least 1,790 Mirena lawsuits are pending in the New Jersey multicounty litigation. Plaintiffs allege that the long-acting birth control device is defective, and can become dislodged and migrate from its correct position in the uterus, leading to uterine perforations and other serious injuries. Bayer Healthcare Pharmaceuticals, the manufacturer of the Mirena IUD, is accused of failing to warn patients and doctors of this possibility, and of downplaying the IUD”s potential risks in marketing materials for the device.
Court records indicate that Bayer has been named in some 3,000 Mirena IUD lawsuits nationwide. In addition to the claims pending in New Jersey, nearly 1,200 similar cases have been filed in the U.S. District Court, Southern District of New York, where federal lawsuits involving alleged spontaneous migration have been consolidated for pretrial proceedings.
