A California state court judge will allow 11 consolidated Essure side effects lawsuits filed by 14 women to move forward against Bayer, the birth control device’s manufacturer. In ruling for the plaintiffs, Alameda County Judge Winifred Y. Smith disagreed with Bayer’s argument that plaintiffs’ claims were pre-empted by federal law and should be dismissed. The California injury lawsuits join Essure side effects lawsuits nationwide accusing Bayer of failing to adequately warn that its Essure permanent birth control system may cause ectopic pregnancy, uterine bleeding, severe abdominal pain, fetal death and other serious injuries.

Essure is a permanent birth control system approved by the U.S. Food and Drug Administration (FDA) in 2002. The device has flexible coils that are inserted into each fallopian tube. Insemination is prevented due to the tubes being blocked by scar tissue that forms around the coils over several months.
Essure came under heavy criticism at a public forum held by the FDA in September. Women reported to FDA officials of experiencing abdominal pain, unexpected pregnancy, miscarriage, headache and other side effects due to Essure. An FDA medical panel called for restricting the use of Essure. In February, the FDA ordered Bayer to place a black box warning on Essure’s label and ordered the company to conduct new studies that assess Essure’s risk in different groups of women.
Meanwhile, U.S. Rep Michael Fitzpatrick, R-Pa. introduced a bill that requires the FDA to rescind its premarket approval of Essure and recall the medical device. When introducing H.R. 3920, the E-Free Act, Rep. Fitzpatrick noted that the deaths of at least four women and five unborn children have been attributed to Essure.
As California plaintiffs move forward in their consolidated Essure injury lawsuits against Bayer, court documents show that a group of plaintiffs have requested a consolidation of all federally filed Essure side effects lawsuits. The plaintiffs filed a petition in July with the U.S. Judicial Panel on Multidistrict Litigation to centralize 30 Essure lawsuits pending in five federal courts nationwide that are filed on behalf of over 1,000 plaintiffs.(In Re: Essure Permanent Birth Control Litigation, Case No. 2:14-cv-07315)
