Bair Hugger Lawsuits Claiming The Forced-Air Warming Blank Used Prior To Surgery Causes Serious Deep-joint Infections After It Circulates Contaminants Investigated By Southern Med Law

The Bair Hugger complaints allege that 3M and its Arizant Healthcare subsidiary misrepresented their forced-air warming blanket as safe and failed to warn that the blanket has the potential to increase the risk of prosthetic joint infections such as sepsis, and Methicillin-resistant Staphylococcus aureus, in patients undergoing hip and knee replacement surgery.

Southern Med Law notes, the U.S. Judicial Panel on Multidistrict Litigation (JPML) issued an order on December 11 to transfer 14 Bair Hugger lawsuits to the Minnesota district court. Judge Joan N. Ericksen was assigned to manage the litigation. The judicial panel stated in its order that the lawsuits share factual issues arising from plaintiffs allegations that the Bair Hugger system is defective because it lifts bacteria from the operating room floor and into the sterile surgical site, and the internal airflow paths of the device’s blower can become contaminated with pathogens that can then be expelled into the operating room. The JPML further stated that the Bair Hugger complaints were transferred to Minnesota because 3M and Arizant have headquarters in that state and “many witnesses and relevant documents are likely to be found there.” (In Re: Bair Hugger Forced Air Warming Devices Products Liability Litigation – MDL No. 2666)

Bair Hugger forced-air warming blankets help to maintain normal body temperatures of patients while undergoing surgery. According to 3M, the Bair Hugger system consists of a warming unit through which filtered air flows. The unit gently and evenly disperses the air throughout the attached blanket, which is placed over the patient. The blanket is isolated from the surgical site by an adhesive strip on the blanket and surgical barrier drapes.[fawfacts.com/_asset/bhbscr/FAW-Facts]

Court documents indicate that the first federally filed Bair Hugger lawsuit claim was among the 14 cases transferred into the newly established MDL. The complaint was filed in 2013 on behalf of a 70-year-old Texas man who underwent a total hip replacement surgery in March 2011. According to the complaint, the man developed a deep-joint infection allegedly due to the Bair Hugger warming blanket used during surgery. The infection caused him to undergo 15 additional surgeries, including a revision surgery for his artificial hip, the complaint said.
