Federal Mirena IUD Lawsuits Move Forward, As Court Prepares to Select Bellwether Cases for Second Deposition Pool

According to an Order recently issued by the Court, a total of 15 cases are to be selected for the litigation’s Second Deposition Pool, one of which will ultimately be chosen for the proceeding’s second bellwether trial. Court documents indicate that more than 1,200 Mirena lawsuits have been filed in the federal litigation underway in the Southern District of New York, where bellwether trials are expected to begin in early 2016. All of these claims were filed on behalf of women who allegedly sustained uterine perforations and other injuries after the small, T -shaped implant became dislocated from its proper position in the uterus. All of the plaintiffs involved in these lawsuits accuse Bayer Healthcare Pharmaceuticals of failing to warn that the Mirena IUD could spontaneously migrate in this manner long after it was correctly placed in the uterus by a healthcare provide. The spontaneous migration of a Mirena IUD can result in uterine perforations, organ damage, ectopic pregnancy, infertility and other complications, according to lawsuits.

In addition to the claims pending in the Southern District of New York, nearly 1,800 similar Mirena IUD lawsuits have been consolidated in a multicounty litigation underway in New Jersey Superior Court. Court documents indicate that bellwether trials will also begin early next year in that litigation. (In Re: Mirena Litigation; Case No. 297)
