Essure Birth Control Lawsuits Allege The Birth Device Can Causes Unexpected Pregnancies, Miscarriages, Severe Abdominal Pain And Other Complications.
A single Essure birth control lawsuit that includes 95 plaintiffs will proceed against Bayer. This comes after a federal court judge refused to dismiss the case and U.S. District Judge Staci Yandle remanded the Essure lawsuit to the Madison County (Illinois) Circuit Court where it was originally filed in July. The complaint mirrors Essure birth control lawsuits filed nationwide alleging Bayer’s Essure permanent birth control system is defective and can cause such injuries as ectopic pregnancy, heavy bleeding, debilitating pain, and fetal death. Bayer removed the case in September to the U.S. District Court, Southern District of Illinois and filed a motion to dismss because the plaintiffs Essure side-effect claims were inadequate and those who did not live in Illinois lacked personal jurisdiction. The plaintiffs live in 27 different states and territories and eight are from Illinois. In October, Judge Yandle found that complete diversity does not exist and since the federal court lacks subject matter jurisdiction, it is “obliged” to send the case back to Madison County Circuit Court, according to a report in the Madison-St. Clair Record.

Essure was approved in 2002 by the U.S. Food and Drug Administration (FDA) as a permanent birth control system. The device has flexible coils that are inserted into each fallopian tube. Scar tissue forms around the coils over a three-month period that blocks the fallopian tubes to prevent conception. Due to the complaints about Essure, the FDA ordered Bayer place a black box warning on Essure’s label and conduct a new clinical study on Essure.
Court documents show that other Essure lawsuits with multiple plaintiffs are moving forward. In September for instance, a mass tort was created in Alameda County Superior Court in California for 55 Essure cases filed on behalf of 900 women. The complaints accuse Bayer of failing to adequately warn that Essure can migrate and perforate organs, and causes such complications as ectopic pregnancy, severe pelvic pain, and autoimmune disorders.
