Essure Side Effects Lawsuits Are Consolidated Into MDL In California

Essure Side Effects Lawsuits Allege The Birth Control Device Caused Experienced Ectopic Pregnancies, Hysterectomies, Punctured Uterus, And Miscarriages.

essure-lawsuit-side-effectsEssure Side Effects Lawsuits Info: Nearly two months after allowing Essure side effect lawsuits to proceed against Bayer, an Alameda County Superior Court judge granted a petition to consolidate all Essure lawsuits filed in California. The Essure birth control lawsuits in California mirror complaints filed nationwide that allege Bayer’s permanent birth control device causes ectopic pregnancy, hysterectomies, uterine bleeding, fatigue, severe abdominal pain, and fetal death.

In an order issued September 30th, Judge Winifred Y. Smith created a mass tort for 55 Essure lawsuits filed on behalf of 900 women. (Essure Side-Effects Product Cases and Coordinated Actions, Judicial Council Coordination Proceeding No. 4887)

“Coordinating the pretrial proceedings for all Essure lawsuits is an efficient use of court resources and will assist in moving the system of justice along for plaintiffs seeking remedy for injuries allegedly from Essure,” says Dr. François Blaudeau, co-founder of Southern Med Law, who is also a practicing obstetrician/ gynecologist and a strong advocate for woman’s medical issues.

consolidating the Essure lawsuit cases

Judge Smith said the Essure lawsuits have common factual and legal questions, and consolidating the Essure lawsuit cases will prevent duplicative discovery, and inconsistent rulings from other courts, among other things. In August, Judge Smith consolidated 11 Essure cases that were pending in her courtroom. Bayer had asked the judge to dismiss the lawsuits since the company maintained it was not liable for injuries the 14 plaintiffs alleged were caused by Essure. Judge Smith denied Bayer’s request and allowed the cases to proceed on the liability issue.

In addition to the California state court, court documents show that federally filed Essure lawsuits are pending in the Eastern District Court in Pennsylvania. About 18 Essure side effects lawsuit claims accuse Bayer of failing to adequately warn patients, their doctors and the FDA about the side effects caused by the birth control device, including unexpected pregnancies, severe bleeding and debilitating pain.(Case No. 2:16-cv-03768, U.S. District Court, Eastern District of Pennsylvania)

What is the essure permanent birth control system

Essure is a permanent birth control system approved by the FDA in 2002. The small device has flexible coils that are placed into each fallopian tube. Insemination is prevented because the fallopian tubes are blocked by scar tissue that forms around the coils over a three-month period. Essure was originally manufactured by Conceptus Inc., which Bayer acquired in 2013. Bayer has maintained in court papers that the company is shielded from product liability lawsuits because Essure went through the FDA’s rigorous pre-market approval process for high-risk medical devices.

FDA mandated black box warning on Essure’s label

After receiving complaints including chronic pain, heavy bleeding, unintended pregnancies, perforation of the uterus or fallopian tubes after Essure migrates from its original position, the FDA held a public hearing on Essure and sought feedback from its medical device advisory committee. As a result, the FDA mandated that Bayer place a black box warning on Essure’s label and mandated a new clinical study to assess Essure’s risk in different groups of women.
