The Essure complaint was filed on August 7 against Bayer Corp., which manufactures Essure, and categorized as a mass tort in the San Diego Superior Court. This Essure MDL mirrors the 5,700 Essure side-effects lawsuit complaints filed against Bayer in courts nationwide. The Essure lawsuits contend the contraceptive causes ectopic pregnancy, chronic abdominal pain, abnormal bleeding, organ perforation, miscarriages, nickel sensitivity, and even fetal death. The recently filed Essure lawsuit noted the problems women said they suffered after having the Essure device implanted. For example, a California woman claimed her doctor did not warn her of Essure’s side effects, but had she known, she would not have had Essure implanted in 2008. The woman said shortly after the procedure, she experienced abdominal and pelvic pain, cramping, and abnormal bleeding. She had the Essure coils removed in 2012, the lawsuit said. This is the second mass tort created in a California court for Essure side-effects lawsuits. In October 2016, 55 Essure lawsuits were consolidated in Alameda County Superior Court on behalf of 900 women. Essure is a permanent birth control system approved by the U.S. Food and Drug Administration (FDA) in November 2002. The device has flexible coils that are inserted through the cervix and vagina and into the fallopian tubes. Over a three-month period, scar tissue forms around the inserts to create a barrier that blocks the fallopian tubes to prevent conception.

The FDA has received over 5,000 adverse event reports over Essure from November 2002 to May 31, 2015. The FDA has been asked to ban the Essure birth control device in the United States. However, the FDA has not pulled Essure off the U.S. market but the agency required Bayer to place a black box warning on Essure’s label about its side effects.

Problems with Essure birth control caused Brazil’s national health agency to suspend Essure sales earlier this year. In addition, Bayer announced in June that it would stop selling Essure in Finland and in Canada because of declining sales. Bayer is facing two proposed class-action lawsuits over Essure in Canada.
