Essure Birth Control Lawsuits Allege Bayer Failed To Warn Of Essure Risks Including Ectopic Pregnancy, Abdominal Pain, And Punctured Organs.

In their July 22 petition to the U.S. Judicial Panel on Multidistrict Litigation, the plaintiffs said there were 30 lawsuits filed on behalf of over 1,000 plaintiffs in five district courts. Since the plaintiffs expect thousands of filings in the future, they asked the federal judicial panel to consolidate and transfer the Essure cases to U.S. District Judge Gerald McHugh in the Eastern District of Pennsylvania, who is currently presiding over three Essure birth control lawsuit claims, the petition said. Plaintiffs also requested to have the cases consolidated in Pennsylvania because Bayer Corporation has it principle place of business in Pittsburgh. The petition also maintained that consolidation of Essure birth control lawsuit cases for coordinated pretrial proceedings is warranted because the complaints have common questions of fact, have allegations of similar injuries, and plaintiffs in each case will seek the same documents from Bayer. Essure is a permanent birth control system approved by the U.S. Food and Drug Administration (FDA) in 2002. Essure has flexible coils that are inserted into the fallopian tubes during a non-surgical procedure in a doctor’s office. The tubes are blocked by scar tissue that forms around the coils over several months which prevents insemination. Since its approval, the FDA directed Bayer to make several changes to Essure’s safety label. In February, the FDA ordered a black box label warning – its most serious warning – and ordered Bayer to conduct new studies that assess Essure’s risk in different groups of women

Despite the safety label changes, U.S. Rep Michael Fitzpatrick, R-Pa., is working to remove Essure from off the market. In November, Rep. Fitzpatrick introduced H.R. 3920, the E-Free Act, which would require the FDA to rescind its premarket approval of Essure and recall the medical device. When introducing the bill, the Congressman said the FDA had received more than 5,000 formal complaints about Essure since 2002. Additionally, the deaths of at least four women and five unborn children have been attributed to Essure, Rep. Fitzpatrick said.
