For all of the up to the minute news on the first DaVinci lawsuit trail against Intuitive Surgical claiming a women suffered serious injuries after a botched hysterectomy that was performed using the DaVinci Robotic Surgical System.
Dr. Francois Blaudeau of Southern Med Law is asking for $300 Million on behalf of his client who underwent a routine hysterectomy that resulted in horrific side-effects. The DaVinci lawsuit trial is taking place in California. The women represented in this Da Vinci robot lawsuit trial had undergone a minimally invasive hysterectomy in 2009, but within weeks of the robotic procedure, the plaintiff’s intestines protruded through her vagina, requiring her to undergo an invasive emergency surgery. She asserts in her lawsuit that her complications were the result of the Da Vinci’s electrified scissors, which she claims were not sufficiently insulated. As a result, electricity was able to surge through the instruments, causing injury to surrounding tissue, including the bowel. The Da Vinci robot lawsuit further contends that Intuitive failed to adequately perform tests on the Da Vinci robot and withheld information from the U.S. Food & Drug Administration (FDA) about its risks.

When speaking with NBC News, Dr. Francois Blaudeau stated that a common malfunction causes electrical currents to leak out of the robotic device during use, causing sparks. This is called “arcing.” This arcing electricity comes from the da Vinci’s monopolar energy instruments that surgeons use to cut and grasp tissue including the Monopolar Curved Scissors, PK gyrus bipolar grasper and Prograf grasper. Surgeons are not always aware of the problem because their view is obstructed by the machine itself, Blaudeau told NBC.
