Bair Hugger Lawsuit Claims Allege Forced-Air Warming Blanket Can Cause Drug-Resistant Infections In Patients Who Have Joint Replacement Surgeries.
As Bair Hugger lawsuit filings continue to grow, the federal judge managing the warming blanket lawsuits is now allowing the complaints to be filed directly into the consolidated multidistrict litigation (MDL). As of May 16, there have been 269 Bair Hugger lawsuit claims filed alleging the forced-air warming blankets may cause drug-resistant infections, including Methicillin-resistant Staphylococcus aureus, to patients undergoing knee and hip replacement surgery. “We’ve talked to people from around the country who developed a severe infection following an orthopedic surgery where a bair hugger warming blanket was used. Allowing these lawsuits to be filed directly into the MDL is better for all those involved and helps to keep the litigation moving forward more efficiently,” says Dr. François Blaudeau, co-founder of Southern Med Law.
In December 2015, the MDL was established in the Minnesota district court so that all Bair Hugger lawsuit claims filed in federal courts across the country can be centralized in one court for coordinated pretrial proceedings. Establishing an MDL helps to prevent duplicative discovery and conflicting pretrial rulings, among other things. Judge Ericksen stated in his records that the direct filings are for pretrial purposes only and she may transfer any case based on the recommendation of the parties to the federal district court where the case would have originally been filed. Bair Hugger Lawsuit Filings Show Need For Additional Surgeries To Treat Infections
Court documents show that a Bair Hugger lawsuit was recently filed into the MDL on behalf of a North Carolina man who said he suffered a severe infection after undergoing a left hip replacement surgery in April 2013. The plaintiff said he needed multiple additional surgeries to remove portions of the hip implant and clean the infected area within weeks from the original implant surgery. The plaintiff claim she continues to “suffer substantial damages, including but not limited to impaired mobility.”
The Bair Hugger forced-air warming blankets maintain patients’ normal body temperature during surgery. According to 3M’s marketing information, the Bair Hugger warming system draws in the operating room’s filtered air, passes it through an internal filter and warms that air to the selected temperature. The warmed air flows to a single-use Bair Hugger warming blanket through a hose attached to the blanket, and is then gently dispersed across the surface of the patient’s skin.
