IVC Filter Lawsuits Contend The IVC Filters Can Migrate, Fracture, Tilt Puncture Vital Organs, And Cause Other Serious Injuries

The total includes recent filings including those by a Texas woman and a Pennsylvania man who both contend that they were seriously injured after being implanted with Inferior Vena Cava (IVC) filters. Plaintiffs involved in IVC filter complaints claim the devices are prone to migrate, tilt, break, puncture the heart, lungs and vena cava and cause other serious injuries.

IVC filters are small, cage-like devices used to capture blood clots and prevent them from causing a pulmonary embolism. The filters are implanted into the inferior vena cava, a large vein that carries blood from the lower part of the body to the heart. IVC filters are implanted in patients who cannot take blood thinners or who took them but the anticoagulant was not ineffective. The U.S. Food and Drug Administration warned in 2010 about complications associated with IVC filters such as tilting, migrating, fracturing, and puncturing the heart, lungs and vena cava. The FDA recommends removing retrievable IVC filters once the risk of blood clots subsides.

C.R. Bard and Cook Medical are involved in separate litigations over their IVC filters. A multidistrict litigation (MDL) for Cook Medical’s Celect and Günther Tulip IVC filters has 1,918 lawsuits pending in the Southern District of Indiana, according to a federal MDL statistics report. (In Re: Cook Medical, Inc., IVC Filters Marketing, Sales Practices And Product Liability Litigation – MDL No. 2570) Lawsuits for C.R. Bard’s Recovery and G2 IVC filters are filed in the District of Arizona where 1,851 cases are pending. (In Re: Bard IVC Filter Lawsuits – MDL No. 2641)

The MDLs include a wrongful death lawsuit recently filed by the family of a Texas woman who allegedly died from injuries resulting from the failure of Bard’s Recovery IVC filter, which was implanted in 2005. The lawsuit alleges Bard’s IVC filter was defective and the company failed to warn of the safety hazards associated with its device. (Case No. 2:17-cv-01235, U.S. District Court for the District of Arizona) On May 26, a lawsuit was filed on behalf of a Pennsylvania man who was allegedly injured by Cook Medical’s Günther Tulip IVC filter. The short form complaint did not list the man’s specific injuries but said the IVC filter was implanted in June 2013. (Case No. 1:17-cv-01762, U.S. District Court for the Southern District of Indiana)
