Bair Hugger warming blanket lawsuits are centralized in the U.S. District Court, District of Minnesota where 341 lawsuit claims were pending on June 15. The Bair Hugger complaints number 470 as of July 15, according to statistics from the U.S. Judicial Panel on Multidistrict Litigation (JPML). The number of filings have been steadily climbing since the JPML established the litigation in December with just 14 Bair Hugger lawsuits. The plaintiffs contend the Bair Hugger blanket lifts bacteria from the operating room floor and into their open wounds during knee or hip replacement surgery. As a result, plaintiffs allege they developed a deep joint infection and had to undergo revision surgery to remove their prosthetic joint or amputate an infected limb. 3M maintains its blankets are safe and used by more than 80 percent of U.S. hospitals. Keeping patients warm during surgery can reduce the risk of infections, reduce the length of hospital stays and improve overall outcomes from surgery, according to 3M. The company’s marketing information says Bair Hugger’s warming system draws in the filtered air of the operating room, passes it through an internal filter and warms that air to the selected temperature. The warmed air flows to a single-use Bair Hugger warming blanket through an enclosed hose, and is then gently dispersed across the surface of a patient’s skin.
Court documents indicate that Judge Joan Ericksen, who is managing the Bair Hugger litigation, wants attorneys for plaintiffs and defendants to propose a plan by October 17 for selecting bellwether cases for trial. Bellwether cases are considered “test cases” that represent allegations in all of the other lawsuits. Judge Ericksen scheduled a trial for November 2017.
