According to 3M, its Bair Hugger warming therapy has become a popular product since it was first approved over 25 years ago by the U.S. Food and Drug Administration (FDA). The forced air surgical blanket, which warms more than 50,000 patients each day, is attached to a warming unit through which filtered air flows. The unit gently and evenly disperses the air throughout the blanket, which is isolated from the surgical site by an adhesive strip on the blanket and surgical barrier drapes.
The use of forced air is among several points of contention patients make in their Bair Hugger lawsuit claims. The complaints maintain that research has shown the forced air assists in spreading airborne contaminates into the sterile surgical site which can potentially cause patients to develop Methicillin-resistant Staphylococcus aureus (MRSA), an infection that is resistant to many antibiotics, (In Re: Bair Hugger Forced Air Warming Products Liability Litigation – MDL No. 2666)
3M and its subsidiary Arizant Healthcare, which makes the warming blanket, contend in their court papers that there is no “credible scientific literature to support plaintiffs’ far-fetched claims that there is an increased risk of infection associated with the Bair Hugger forced air warming device.” Plaintiffs, however, point to several studies that support their claims, including one published in The Bone & Joint Journal in November 2013. Researchers found that waste heat from forced-air warming devices significantly disrupts the airflow in operating rooms, and draws contaminated particles from below the operating table and the operating room floor into the sterile surgical site.
In December, the U.S. Judicial Panel on Multidistrict Litigation centralized all federal Bair Hugger lawsuits in the U.S. District Court, District of Minnesota, for coordinated pretrial proceedings. One lawsuit filed recently involved an Illinois man who underwent a left leg open reduction internal fixation in June 2014, and a Bair Hugger warming blanket was used. The complaint stated the man sustained a periprosthetic infection during surgery due to the warming blanket lifting contaminants up to his open surgical site. According to the lawsuit, the plaintiff experienced such persistent pain due to the deep joint infection that he was forced to undergo multiple revisions surgeries, one of which used a Bair Hugger blanket.
